1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Neonetwork Solutions (“we,” “us,” or “our”). By accessing the website at vpnifyapp.com or using our mobile applications (the “Service”), you agree to be bound by these terms and all applicable laws. If you do not agree, you are prohibited from using the Service.

2. The Service (Freemium Model)

vpnify provides an unsupervised and non-monitored data conduit—a Virtual Private Network (VPN) connection—for your exclusive use at your own risk.

Free Service: Access is provided free of charge and is supported by advertisements delivered through third-party partners (e.g., Google AdMob).

Premium Upgrades: Optional paid subscriptions remove advertisements and provide priority server access.

Data as Consideration (EEA/EU Users): In accordance with EU Directive 2019/770, users of the Free Service acknowledge that providing access to certain digital identifiers (like advertising IDs) for ad-personalization constitutes contractual consideration.

3. Privacy and No-Logs Policy

Privacy is our core mission. vpnify operates under a strict No-Logs Policy, which has been designed so that we have no data to share even if compelled by legal authorities:

  • No Registration: Our apps do not require an account, email, or phone number. Your connection is never linked to your identity.
  • No Activity Logs: We do not record the websites you visit, the apps you use, or your DNS queries.
  • No Connection Logs: We do not store your real IP address, assigned VPN IP, connection timestamps, or session durations.

4. Eligibility

You must be at least 18 years old to use the Service. Minors over the age of 13 may use the Service only with verifiable parental or legal guardian consent. In certain EEA jurisdictions, higher age requirements for digital consent may apply (up to 16 years).

5. Acceptable Use Policy (AUP)

You are solely responsible for all actions performed through the Service. Prohibited activities include:

  • Illegal Acts: Using the VPN for criminal acts, including but not limited to, fraud, hacking, or violating any jurisdiction’s laws.
  • Infrastructure Abuse: Engaging in port scanning, sending “spam” or unsolicited bulk email, or launching attacks (DoS) against other networks.
  • Child Safety: We have zero tolerance for the exploitation of children. Accessing or distributing Child Sexual Abuse Material (CSAM) is strictly prohibited and will result in immediate termination and reporting to authorities.
  • IP Infringement: Downloading or distributing copyrighted materials without permission from the owner.

6. Payments and Refunds

Third-Party Billing: All in-app purchases and subscriptions are handled by the Apple App Store or Google Play Store. Their respective terms govern billing and payment.

Right of Withdrawal (EU/EEA): Users in the EU/EEA have a statutory right to withdraw from a premium subscription within 14 days of purchase. To exercise this right, you must contact the respective App Store provider directly.

Cancellation: You may cancel your subscription at any time via your device’s account settings. Access will remain active until the end of the current billing cycle.

7. Use License

We grant you a personal, non-exclusive, non-transferable license to download and use the vpnify application. You may not:

  • Modify, copy, or attempt to reverse engineer the software.
  • Use the Service for any commercial purpose without prior written consent.

8. Disclaimers and Limitation of Liability

“As-Is” Performance: The Service is provided on an “as-is” and “as-available” basis. We do not warrant that the Service will be uninterrupted, error-free, or 100% available in all countries.

Liability Cap: To the maximum extent permitted by law, Neonetwork Solutions Ltd and its affiliates shall not be liable for any damages (including loss of data or profit) arising from the use or inability to use the Service. Our total liability is capped at the amount paid by you to us in the 12 months preceding the claim.

9. Governing Law

These terms are governed by and construed in accordance with the laws of Hong Kong. You irrevocably submit to the exclusive jurisdiction of the courts in Hong Kong for any dispute arising from these terms.
